PHOTOGRAPHY
TERMS AND CONDITIONS
1.Definitions for the purpose of this agreement:
This agreement is between the client booking the photography session, hereinafter referred to as the "Client," and Perri Newton Photography, herein after referred to as the "Photographer."
2.Entire Agreement:
This agreement contains the entire understanding between the Client and the Photographer
3.Co-operation:
The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. The Photographer is not responsible if the Client or key individuals fail to co-operate during photo session. The Photographer’s camera is the only camera allowed at the photo session.
4.Copyright Law:
The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Client. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. Alternation of any images handed to the client is strictly forbidden by anyone other than the original photographer, you may not pass copies of any images to any other professionals without the prior consent of your photographer, and then if permission is granted only small file watermarked versions can be shared and the said professionals must link back to www.perrinewtonphotography.com
RAW images will remain the property of the photographer and cannot be transferred to the client or purchased.
5.Exclusivity:
All images and copyrights are the property of Perri Newton Photography. The Client grants the Photographer unlimited consent and all rights to use the photographs in any manner, at any time, and in any part of the world, for the purpose of advertising or otherwise promoting her work, including editorial, competition, awards and, to alter the photographs without restriction; and to copyright the images. Medium for display could include the Internet, social media, magazines, books, newspaper and television, but are not limited to those mediums. The Client hereby releases the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.
7.Client Confidentiality:
The Photographer will be confidential and will not disclose to any third parties or make use of the material or information communicated to her in confidence for the purposes of the photography, excluding that which may be reasonably necessary to enable the Photographer to carry out her obligations in relation to the commission.
8.Editing:
The Photographer has full rights to make the selection of the images that she feels are the images that reflect her style and quality of work. During the image selection process any images that are not suitable for selection are removed and not available to the client, the Photographer is allowed to have full artistic licence with editing.
Editing time after the session can be up to 3 weeks but is often less, the digital files are delivered as soon as purchased or chosen.
9.Payment and Sales:
Payment by the Client will be expected for the commissioned work as agreed. Digital files and/or prints will not be obtained until payment in full has been made.
Perri Newton Photography reserves the right to reduce the cost of sessions or digital files at times throughout the year as an "offer" or "sale." If you have paid full price for a session or digital files at another date it is not possible to then receive the discounted price for items previously purchased at an earlier date, this includes (but not limited to) gift vouchers and advance bookings.
10.Liability and Indemnity:
If the Photographer is too ill or becomes injured and cannot attend the Client’s session, another alternative date can be arranged. The Photographer cannot be held liable for any loss of earnings incurred for missed sessions and will reschedule to a session that suits the client.
Upmost care is taken with the retouching of digital captures, in the unlikely event that all originals are lost, stolen, damaged or destroyed within or beyond the Photographer’s control, the Photographer’s liability is limited to the refund of all payments received, or a re-shoot scheduled at no additional cost.
The Photographer is not liable for loss or damage to the Client’s goods or any third party as a result of photographic session.
11.Right to a Credit:
The Photographer asserts her Right to a Credit and the Photographer’s name should be printing on or in reasonable proximity to all published productions of the photograph(s).
12.Rejection:
There is no right to reject on the basis of style or composition.
13.Applicable Law:
The agreement shall be governed by the laws of England and Wales.
14.Variation:
These Terms and Conditions shall not be varied except by agreement in writing.
